Registration and Membership
In order to enjoy all the benefits of AromaPersona, you must register and become a member. At the time of registration, you have the option to become an official member by placing a first order and providing payment and shipping information for your account. Once you have placed your first order, you become an official member of AromaPersona. Although AromaPersona goal is to provide you with exceptional quality at an affordable price, there is no monthly commitment to be a member. You may cancel your membership at any time by calling our Billing Services department at (888) 316-5463, and press Option 3. Let one of our Billing Representatives know you would like to cancel, and they will take care of you from there.
As either a paying or non-paying member of AromaPersona, you agree to receive emails, newsletters and other communications announcing your monthly selections. As a member, you will receive a monthly selection, which you may view when you visit account. At this time, you can pick any selection in your personal showroom, and it will be shipped to you after your credit card payment is successfully processed. Your selection will be sent according to our Shipping Policy.
If, as a paying member of AromaPersona, you choose not to forgo a decision to either skip the month or make a selection in the first 5 days of the month ("the selection period") we will apply one redeemable credit valued at $19.95 to your account information page. You are free to use the credit any at any time or any purchase in the future.
Paying by Credit Card
For your convenience, when you place your first order and become an official AromaPersona member, we will save your credit or debit card information and use it for all future shipments and charges. We are not responsible for any fees or charges that your bank or credit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method including a mailed statement. We accept the following credit cards at this time: VISA, MasterCard and Discover Card.
Shipping and Exchanges
If at any time you are unsatisfied with your product, you may exchange it within 30 days. Shipping, and exchanges of any products ordered through the Site or in connection with your membership are subject to the AromaPersona Shipping and Exchanges Policy. All products returned for a exchange are subject to a $9.95 restocking fee to be charged on the same credit card used for purchase.
Replacement of products for shipped merchandise claimed as not received are subject to our investigation. We will adjust your account at our discretion. Repeated claims of undelivered merchandise may result in the cancellation your membership.
Risk of Loss
The risk of loss and title for items purchased by you pass to you upon AromaPersona delivery of the items to the carrier per AromaPersona’s Shipping and Exchanges Policy.
Local Taxes
You may be charged local sales tax, if applicable.
International Access
This Site may be accessed from countries other than the United States. This Site may contain products or references to products that are not available outside of the United States. Any such references do not imply that such products will be made available outside the United States. If you access and use this Site outside the United States you are responsible for complying with your local laws and regulations.
Membership Cancellation
We will do everything to make your membership as satisfying as possible. However, you are free to cancel your membership any time by Calling our Billing Services Department at (888) 316-5463, option 3. If it is deemed necessary we may terminate your membership, without notice, for conduct we believe violates this Agreement or our policies, is harmful to other Members or our business interests.
Dispute Resolution
If there is any dispute between us, it is agreed that either of us may elect to have it resolved by proceeding in small claims court or by binding negotiation administered by the National Arbitration Forum, the American Arbitration Association, or JAMS under their rules for consumer settlements. All disputes in settlement will be handled just between the named parties. The arbitrator shall not have authority to conduct any proceedings on a class, private attorney general, or other representative basis; nor to entertain any claim of, nor provide any relief to any person who is not a named party; nor to join or consolidate claims by or for individuals with different accounts. You acknowledge that this means that you may not have access to a court or jury.
Remedies
You agree that AromaPersona's remedy at law for any actual or threatened breach of this Agreement would be inadequate and that AromaPersona shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that AromaPersona may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys' fees.
No right or remedy of AromaPersona shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys' fees and expenses.
No instance of waiver by AromaPersona of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future or other waiver.
